By registering an account, signing in, or utilizing any services provided by Daesen, you represent and warrant that you are at least 18 years of age and hold full legal capacity to enter into this legally binding Terms of Service agreement.

Platform access and use by individuals under 18 years of age is strictly prohibited. If we discover that an account has been registered by a minor, we will immediately terminate the account and purge all associated personal records.

Platform access requires registering a workspace user account, either via direct corporate email and password credentials or through federated single sign-on with Google Identity Services or Microsoft Entra ID.

• ✓You are solely responsible for preserving the confidentiality of your login credentials and for all activities executed under your account or organization workspace.
• ✓You must immediately alert Daesen at support@daesen.com regarding any discovered security breach or unauthorized workspace access.

Daesen grants clients a limited, non-exclusive, non-transferable, and revocable commercial license for the duration of their active subscription to access the SaaS platform, utilize the deterministic DSL compiler, work within the Monaco Survey Studio IDE, and generate survey export assets.

• ✓Daesen Ownership: All rights, title, and intellectual property in the software, isomorphic compiler, grammar rules, system components, brand identity, and documentation remain the exclusive property of Emmanuel Cortés Padilla.
• ✓Client Ownership: The client retains 100% exclusive ownership, copyright, and trade secret protection over their research questionnaire specifications, Word (.docx) documents, DSL scripts (.fdsl), quotas, skip logics, and all collected respondent data. Daesen claims zero ownership over your research assets.

Access to advanced survey engineering tools is provisioned across structured subscription tiers (Starter, Professional, and Enterprise) available on monthly or annual billing plans (including a 20% annual discount):

• ✓Secure Payments: All transactions are processed via Stripe Inc. under PCI-DSS SAQ A compliance.
• ✓Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the renewal date via the in-app billing portal.
• ✓Cancellation & Refunds: You may cancel your subscription at any time; your cancellation will take effect at the conclusion of the active prepaid billing term. Unless required by mandatory consumer law or due to verified platform outages attributable to Daesen, subscription fees are non-refundable.

As an express condition of service access, you agree not to utilize Daesen to:

• ✓Conduct deceptive surveys, phishing schemes, malicious credential harvesting, or unauthorized collection of sensitive financial information.
• ✓Reverse engineer, decompile, disassemble, or attempt to derive source code from the isomorphic DSL compiler or runtime interpreter.
• ✓Launch denial-of-service (DoS/DDoS) operations, automated vulnerability fuzzing, or intentionally bypass API quotas or rate limiters.
• ✓Upload unlawful, defamatory, or infringing materials that violate third-party intellectual property or international privacy statutes.

Daesen facilitates seamless integration with commercial research panel suppliers (such as Dynata, Cint, PureSpectrum, Lucid) via tokenized parameter redirects:

• ✓Clients are solely responsible for correctly configuring respondent token parameters (PID/RID) and executing commercial supply agreements directly with panel vendors.
• ✓Daesen is not liable for participant sample fulfillment quality, vendor uptime, or panelist financial incentives managed by third-party providers.

Daesen strives to maintain continuous platform availability exceeding 99.5%, backed by proactive maintenance and redundant AWS cloud infrastructure:

• ✓The platform is provided on an as is and as available basis. To the maximum extent permitted under applicable law, Daesen disclaims all implied warranties of merchantability or fitness for a particular purpose.
• ✓In no event shall Daesen or its founder be liable for indirect, incidental, punitive, or consequential damages, including loss of profits, enterprise data, or business opportunities. Daesen's total aggregate liability arising from any claim shall not exceed the total fees paid by the client during the twelve (12) months preceding the incident.

Daesen respects intellectual property rights and adheres to the Digital Millennium Copyright Act (DMCA). If you believe content hosted on our platform infringes your copyright, please dispatch a formal notice to our designated agent:

• ✓Provide a description of the copyrighted work, the specific URL where the infringing content resides, and your signed sworn declaration.

We reserve the right to amend these Terms of Service to reflect system enhancements, regulatory shifts, or product expansions:

• ✓We will provide notice of material modifications at least 30 days prior to their effective date via email or platform notification. Continued use after the effective date constitutes acceptance of revised terms.
• ✓These terms are governed and construed in accordance with the laws of the United Mexican States and international electronic commerce standards. Any dispute shall be resolved before the competent courts of Puebla, Mexico, with the parties waiving any other applicable jurisdiction.
